Elizabeth Anne Holmes (/hmz/; born February 3, 1984) is the founder and CEO ofTheranos, a privately held blood test company based in Palo Alto, California that is under regulatory and financial scrutiny for alleged fraud.[3] In 2015, Forbes named Holmes as the youngest self-made female billionaire in the world due to a $9 billion valuation of Theranos.[4] The next year Forbes revised her net value "From $4.5 Billion to Nothing".[2]

In 2016, after a series of journalistic and regulatory investigations that questioned the veracity of Holmes' claims, federal prosecutors began criminal investigations for potentially misleading investors and the government about Theranos' blood-testing technology. Following the revelation of potential fraud,Fortune named Holmes one of the "World's Most Disappointing Leaders".[5] In 2016, theCenters for Medicare and Medicaid Services(CMS) banned Holmes from owning, operating, or directing a diagnostic lab for a period of two years.[6] In April 2017, Theranos announced that it had reached a global settlement agreement with CMS, under which CMS withdrew the revocation of the company’s Clinical Laboratory Improvement Amendments operating certificates and reduced its civil monetary penalty.[7]

In December 2017, Theranos settled a lawsuit brought by the State of Arizona alleging that the company had sold 1.5 million blood tests to Arizonans while concealing or misrepresenting important facts about those tests. The company agreed to pay $200,000 in civil fines, and refund the cost of the tests to Arizona consumers.[8]

In March 2018, the U.S. Securities and Exchange Commission sued Holmes and Theranos, accusing them of fraudulently raising more than $700 million from investors through false or exaggerated claims. In exchange for settling the charges, Holmes agreed to pay a $500,000 fine, return 18.9 million shares, relinquish her voting control of Theranos, and be barred from serving as an officer or director of a public company for ten years.[9][10]

Early life[edit]

Holmes was born in February 1984 in Washington, D.C. She is the daughter of government service worker Christian Holmes IV and congressional committee staffer Noel Daoust. When she was 9 years old, Holmes and her younger brother Christian Holmes V moved toHouston, Texas due to her family's job relocation.[11] She wrote a letter to her father about the move saying, "What I really want out of life is to discover something new, something that mankind didn't know was possible to do."[12] Holmes studied Mandarin as a child and completed three years of summer language classes at Stanford University before graduating from high school.[11]

She attended St. John's School in Houston and was recognized for her "tireless optimism and a particularly warm smile."[13] During high school, Holmes was interested in computer programming and started her first business selling C++ compilers to Chinese universities.[14] In 2001, Holmes applied to Stanford University and was named a President's Scholar, which came with a stipend to use on a research project. She studied chemical engineering and used the stipend to work in a lab with Ph.D. candidates and Channing Robertson, dean at the engineering school.[11]

After the end of her freshman year, Holmes worked in a lab at the Genome Institute of Singapore on testing for severe acute respiratory syndrome (SARS) through the collection of blood samples with syringes.[14] She filed her first patent on a wearable drug-delivery patch in 2003.[15][16] In March 2004, she dropped out of Stanford's School of Engineering and used her tuition money as seed funding for a consumer healthcare technology company.[11][17]

Theranos[edit]

Founding of Theranos[edit]

Holmes founded the company in Palo Alto, California as Real-Time Cures to "democratize healthcare."[14][18] Her goal was to make health information accessible to all people at any time so that risk of disease and health conditions could be detected early on.[14][19][20] In April 2004, she incorporated the company as Theranos (a portmanteau of "therapy" and "diagnosis")[21] and rented the basement of a group college house.[11] At that time, Holmes hired her first employee and rented lab space.[22] Robertson became the company's first board member and introduced Holmes to venture capitalists.[11]

Funding and expansion[edit]

By December 2004, she had raised $6 million to fund Theranos.[11] The company's first revenue came from contracts Holmes established with pharmaceutical companies to conduct testing and other clinical trials.[22] By the end of 2010, Holmes had more than $92 million in venture capital for Theranos.[15] In July 2011, Holmes was introduced to former Secretary of State George Shultz. After a two-hour meeting, he joined the Theranos board of directors.[23] She was recognized for forming "the most illustrious board in U.S. corporate history" over the next three years.[24] Holmes operated Theranos in stealth mode without press releases or a company website until September 2013 when the company announced a partnership with Walgreens to make in-store blood sample collection centers.[25][26]

Media attention increased in 2014 as she was on the cover of Fortune, Forbes, T: The New York Times Style Magazine and Inc., who considered her "The Next Steve Jobs".[27]Forbes recognized Holmes as the world's youngest self-made female billionaire and ranked her #110 on the Forbes 400 in 2014. Theranos was valued at $9 billion with more than $400 million in venture capital.[11][28] By the end of 2014, she had 18 U.S. patents and 66 foreign patents in her name.[16]

During 2015, Holmes established agreements with Cleveland Clinic, Capital BlueCross and AmeriHealth Caritas to use Theranos technology.[15]

Questions about Theranos[edit]

The Wall Street Journal reported in October 2015 that the Edison blood-testing device by Theranos might provide inaccurate results.[29] Holmes denied the claims and said the company would publish data on the accuracy of its tests.[30][31]

In January 2016, the Centers for Medicare and Medicaid Services (CMS) sent a warning letter to Theranos after inspecting its Newark, California laboratory.[32] CMS regulators proposed a two-year ban on Holmes from owning or operating a blood lab after the company had not fixed problems within its California lab in March 2016.[33] On The Today Show, Holmes said that she was "devastated we did not catch and fix these issues faster" and that the lab would be rebuilt with help from a new scientific and medical advisory board.[34] In July 2016, the CMS banned Holmes from owning, operating, or directing a blood testing service for a period of two years. (The company has appealed that decision to a U.S. Department of Health and Human Services appeals board.)[35][36] Shortly thereafter,Walgreens ended its relationship with Theranos and closed its in-store blood collection centers. The FDA also ordered the company to cease using its Capillary Tube Nanotainer device.[37]

Other reported ongoing actions include civil and criminal investigations by the U.S. Securities and Exchange Commission and the U.S. Attorney's Office for the Northern District of California, an unspecified FBI investigation, and two class action fraud lawsuits. Holmes is reportedly standing by all of her company's claims and has denied any wrongdoing.[35] In April 2017, Theranos announced that it had reached a global settlement agreement with CMS, resolving all outstanding legal and regulatory proceedings.[7]

On May 16, 2017, approximately 99% of Theranos shareholders reached an agreement with the company to dismiss all current and potential litigation in exchange for shares ofpreferred stock. Holmes released a portion of her equity to offset any dilution of stock value to non-participating shareholders.[38][39]

On March 14, 2018, Holmes settled an Securities and Exchange Commission lawsuit alleging fraud by making false or misleading statements about Theranos' technology and business.[40] The fraud of the company included claiming the company's technology was being used by the US Department of Defense in combat situations despite never having been used (Defense Secretary Jim Mattis pushed for use of the technology although it was never materialized).[41] Another false claim included claiming a $100 million revenue stream in 2014 that was actually $100,000.[42] The terms of the settlement included surrendering voting control of Theranos, a ban on holding an officer position in a public company for 10 years, and a $500,000 fine.[43]

Philanthropy[edit]

Holmes partnered with Carlos Slim Helú in June 2015 to improve blood testing in Mexico.[44]In October 2015, she announced #IronSisters to help women in science, technology, engineering and mathematics (STEM) careers.[45] She helped to draft and pass a law in Arizona to let people obtain and pay for lab tests without requiring insurance or healthcare provider approval.[46]

Awards and recognition[edit]

Prior to journalist investigations, criminal investigation, civil suits, and being charged with "massive fraud" by the Securities and Exchange Commission,[47] Holmes was named one of TIME's Most Influential People in the World in 2015.[48] Holmes received the "Under 30 Doers" Award from Forbes and ranked on its 2015 list of the "Most Powerful Women".[49][50]She was also named "Woman of the Year" by Glamour.[51] Holmes was awarded the 2015Horatio Alger Award, being the youngest recipient in its history.[52][53] She had also previously been named Fortune's "Businessperson of the Year" and "40 Under 40" lists.[54][55]

Following the scrutiny over the Theranos lab controversy, Fortune named Holmes one of the "World's Most Disappointing Leaders" for 2016.[56]

In 2015 She was awarded the Honorary degree of Doctor of Humane Letters (DHL) fromPepperdine University in Malibu, California, She also served as the Commencement speaker at that ceremony. [57] As of March 2018 her honorary degree has not been revoked.

Holmes' father, Christian Rasmus Holmes IV, worked in the United States, Africa, and China as part of government agencies such as USAID.[1] Her mother, Noel Anne Daoust, worked as a Congressional committee staffer.[11]Holmes describes her fear of needles as one of her motivations for founding Theranos.[19][35] Holmes is a descendant of Christian R. Holmes, a surgeon, engineer, inventor, and a decorated World War I veteran,[58] and his wife Betty, a daughter of Charles Louis Fleischmann.[59]

Prior to the March 2018 settlement, Holmes held a 50-percent stock ownership in Theranos.[14] Forbes listed her as one of "America's Richest Self-Made Women" in 2015 with a net worth of $4.5 billion.[28] In June 2016, Forbesreleased an updated valuation of $800 million for Theranos, which made Holmes’s stake essentially worthless, because other investors owned preferred shares and would have been paid before Holmes, who owned only common stock.[2] Holmes reportedly owes a $25 million debt to Theranos in connection with exercising options. She did not receive any company cash from the arrangement, nor did she sell any of her shares, including those associated with the debt.[60][61][62]

Holmes's preferred daily uniform of a black turtleneck with a puffy black vest is generally assumed to be an imitation of her role model Steve Jobs,[35] but in an interview with CNN's Dr. Sanjay Gupta, she said, "I was a young woman in a world in which there aren't a lot of young women, and I didn't want how I looked or what I wore to be what people were paying attention to. So I dressed very conservatively for a very long time, until it became all that everybody was talking about. And then, when that became what people were talking about, I changed it, because it was never about that."[63]

靠詐騙能變億萬富豪嗎?伊莉莎白(Elizabeth Holmes)就可以。她創辦的企業Theranos標榜「滴血驗病」,是矽谷最炙手可熱的新創公司,卻被踢爆是世紀騙局。該公司日前宣布將解散,但伊莉莎白的「成功」之道仍值借鏡。

2004年,20歲的伊莉莎白從美國史丹福大學輟學創業,標榜只須手指扎幾滴血,即可做上百種檢驗。她被譽為「女版賈伯斯」,身價一度高達新台幣1400億元。

但2015年《華爾街日報》記者凱瑞魯(John Carreyrou),踢爆伊莉莎白公司涉嫌詐騙,不只偽造數據、虛報營收,自家儀器也錯誤百出。東窗事發後,估值曾逾新台幣2700億元的Theranos今年9月初宣布解散。

一是「發掘痛點」。抽血10毫升、花50美元,等兩天才能知結果,是一般人熟悉的驗血運作模式。伊莉莎白卻能另類思考:為何不能只抽一滴血、立刻讓病人知道結果?

2010年2月,伊莉莎白的公司寄給連鎖藥局沃爾格林(Walgreen)一封電郵,表示他們開發出一種小裝置,只須在手指上扎幾滴血就能即時進行任何檢測,成本不到傳統實驗室的一半。沃爾格林的主管「立刻看出這項技術的潛力,若把這新創公司的機器搬進門市,將帶來大筆營收,成為改變市場遊戲規則的人。」

「發掘產業痛點」,意味找出更有效率的新方式滿足市場需求,說服人們此乃商機所在,這正是伊莉莎白成功的第一個原因。她也因此利用業者間的競爭來牟利。

伊莉莎白第三個「成功學」是利用名人。生技業技術門檻高,外人難窺堂奧。伊莉莎白卻利用家族與師友人脈,讓前國務卿季辛吉、舒茲加入董事會;美國前總統歐巴馬在位時,還指派她擔任美國全球創業大使。圈外人見有名人背書,自然心服。

2014年6月的《財星》(Fortune),將伊莉莎白做為封面故事,寫作記者也是「聽到董事會一個又一個知名人士鏗鏘有力的背書,讓他相信她必定是真才實料。」之後伊莉莎白登上《富比世》全美四百大富豪,《時代》雜誌將她列為全球最有影響力的百大人物之一,哈佛醫學院邀她加入榮譽學者群,伊莉莎白名氣因此越滾越大。

聲稱靠著一滴血就能驗出癌症的血液檢測公司「Theranos Inc.」,估值曾一度達到90億美元(約新台幣2,700億元),前執行長伊莉莎白霍姆斯(Elizabeth Holmes)被譽為是「女版賈伯斯」,躍上各大財經雜誌封面,但不久被踢爆數據造假,就此跌落神壇,還面臨美國證券交易局提告與集體訴訟。今(10日)傳出,伊莉莎白霍姆斯將以精神異常為由,為自己辯護,尋求減輕罪刑或脫身的機會。

《彭博》報導,昨(9日)曝光法院文件顯示,伊莉莎白霍姆斯呈交自己罹患「精神疾病或缺陷」以及「因罪惡感導致的精神狀況」的證據,盼以此反制檢方證明她是故意違法。

伊莉莎白霍姆斯證明自己有「精神異常」的證據,來自富勒頓加利福尼亞州立大學的臨床心理學家明迪梅肯特(Mindy Mechanic),根據校方官網自介,明迪梅肯特是研究創傷後心理影響的專家,尤其是被家暴的婦女,並經常在人際暴力的案例中提供專家證詞。

原本伊莉莎白霍姆斯提出,希望以明迪梅肯特的證詞取代,以跳過法院由政府專家進行心理評估的程序,但遭地方法院法官愛德華達維拉(Edward J. Davila)拒絕。其實之前伊莉莎白霍姆斯的精神狀況就已經是雙方攻防焦點,但過去都是非公開進行,直到昨日才被揭露。

矽谷新創公司「Theranos Inc.」成立於2004年,聲稱靠著微量的血液就能進行癌症檢測,吸引了許多知名投資人投資,2015年達到巔峰估值達90億美元(約新台幣2,700億元),獲得挹注的資金達4億美元(約新台幣120億),前執行者是伊莉莎白霍姆斯還被稱做全球最年輕、白手起家的億萬富翁。但事後被踢爆,伊莉莎白霍姆斯聲稱的技術只是一場騙局,使得她最後黯然下台,並被下禁令,10年內不得擔任上市公司的高級主管或董事,現正面臨多起訴訟。

〔編譯楊芙宜/綜合報導〕美國聯邦陪審團裁定,標榜「滴血驗病」的血液檢測新創公司Theranos創辦人霍姆斯(Elizabeth Holmes)共謀詐欺投資人,十一項罪名中有四項成立,將面臨最長廿年牢獄之災;曾被譽為「女版賈伯斯」的霍姆斯身家一度高達四十五億美元(約一二三八億台幣),其設下的創新騙局,曾吸引媒體大亨梅鐸等知名富豪支持。

霍姆斯 詐欺罪名成立

加州聖荷西陪審團經過三個月庭審證詞後裁定,霍姆斯在十一項共謀和詐欺指控中,四項對投資人的共謀詐欺罪名成立,四項對病人的共謀詐欺罪名不成立,另三項涉及其他散戶投資者的罪名未做出裁決。霍姆斯身穿灰色套裝出庭聆聽,神情淡定。法官宣判日期未立即敲定。

檢察官表示,霍姆斯從二○一○至一五年詐騙民間投資人,宣稱Theranos一台小小機器,只需要手指針戳一滴血,就能進行一連串醫療檢測;其實,該公司秘密依靠西門子製造的傳統機器執行病人檢測。霍姆斯和Theranos前營運長巴瓦尼(Ramesh "Sunny" Balwani)在二○一八年遭起訴。

19歲創立公司 身家1238億

霍姆斯聲稱Theranos小型設備可比傳統大型機器更快且更準確的便宜執行數百項診斷檢測,吹噓這將在醫療領域掀起一場革命,還稱自己對針頭的恐懼是該技術發明的靈感來源。

富比世二○一五年把霍姆斯譽為史上最年輕白手起家的女性億萬富豪,估算她身家四十五億美元;但華爾街日報同年一系列調查報導揭露Theranos機器缺陷不精確、揭發霍姆斯的騙局,促使Theranos開始崩解。

愛模仿賈伯斯穿著風格

Theranos及霍姆斯的故事被寫成「惡血:矽谷獨角獸的醫療騙局」一書,在全球多國出版。霍姆斯在僅十九歲時就成立Theranos的前身公司,她從模仿蘋果公司共同創辦人賈伯斯喜愛黑色高領毛衣的穿著風格,到自史丹佛大學休學的背景,都是矽谷創業家典型形象,並吸引許多達官顯要支持。

霍姆斯創辦Theranos後,擔任執行長近15年之久。Theranos號稱只需要分析少量血液,就能檢驗多種疾病,於是數以億計資金流向這家公司,許多人相信這會是下一家蘋果公司(Apple)或谷歌(Google),甚至一度將霍姆斯與蘋果已故創辦人賈伯斯(Steve Jobs)相提並論,結果大失所望。

「華爾街日報」報導,聯邦地區法院法官戴維拉(Edward Davila)命令霍姆斯於明年4月27日向獄政機關報到,法院也將擇期舉辦關於賠償的聽證會。霍姆斯今年稍早因在Theranos執行多年詐欺計畫而被定罪。

戴維拉稍早表示,現有證據足以判定至少有10名投資Theranos的人受詐欺所害,被騙金額共達1.211億美元(約新台幣37.7億元)。

陪審團今年1月認定霍姆斯向投資人不實陳述Theranos的技術、財務狀況和企業前景,因此4項罪名成立。

法官宣告判決後,霍姆斯可在14天內提出上訴。她的律師將設法讓她在上訴期間保釋出獄。

霍姆斯曾希望被判在家監禁和社區服務,且入獄服刑不要超過18個月。她的律師請求法庭寬容量刑時,聲稱霍姆斯是關懷他人、富有慈愛的母親,身邊帶著一個剛會走路的孩子,肚裡還懷著第2胎,一旦入獄,對她的家庭和社區只會有不利影響。
